I'm still studying the roles of the three branches of the US Gov't. I keep coming back to wondering why the Executive Branch can't just refuse to enforce SCOTUS judgments or Congress not fund their decisions. FGS, the right wing cheats at every opportunity, can't the remaining two branches fight back in a manner that still remains constitutional?!?
Though there are three branches of government, the judiciary's responsibilities are always overlooked. Unknown to the public, it is regulated by rules of conduct. Revealingly, it has systematically violated those rules. The other judiciary functions depend upon this not being the case. But it is the case. Everything changes when this is known.
"The longstanding conservative project of grinding the administrative state to a halt is seeing great success under this Court." This was the necessary first step for Project 2025. I have been hesitant to support suggestions to expand the Supreme Court but now I fully support such a plan. Elie Mystal has been right all along. Republicans, and most of the people who run major corporations, want a return to the days of the Robber Barons, where there are no regulations to prevent corporations from doing whatever they want to increase their profits, and their own wealth. Research has proven that trickle-down doesn't work but Republicans want to cut corporate taxes even further. I'm old enough to remember when the air in some of our major cities was horrendous, when you couldn't swim in many rivers. Do you really want judges deciding if your food is safe, if your medicine has been sufficiently tested before being allowed on the market, if your work environment is safe, if you should be paid for overtime, if it's okay for landlords to conspire to control rents, if cars really need so many safety features, if monopolies are really okay. I think this message needs to be made very clear to everyone, but especially younger voters who care about climate change. This ruling will be a disaster and will also clog up the courts with so many lawsuits the system won't be able to work and this is what Republicans want.
I imagine that only a small percentage of people have any awareness of this case. With nearly 40 million people in the United States living in poverty, there is a huge group of people focused on survival and not on following court cases. This case will have the greatest impact on that segment. Ironically, the Chevron headquarters is located in Northern California, far away from the big rigs in the Gulf of Mexico. The rethuglicans stoke anger and fear the way a magician creates distractions. And, as you note, they have a court bought and paid for who seek power for power’s sake. Ugh!
Today’s “decision”/non-decision should be the final nail in the coffin of our democracy. It seeks to make the President a dictator, immune from prosecution, free to do whatever he wishes independent of any point of control over his actions. This decision is our marching order. We need to defeat Donald Trump and we certainly need to regain control of the House and increase control in the Senate. We need an expanded Supreme Court to overturn the damage from Trump’s first term in office and return a balance to our country. If we do not succeed, many of us will never, ever see the democracy we’ve grown up with and leave our children and grandchildren with a giant pile of poop in which they need to navigate their lives. This is unacceptable. We need to take action now. VOTE BLUE. Or else.
"Independent control" over the actions of any branch of government is the key. The judiciary
is comprised of judges, state bar associations and prosecutors and it is regulated by rules of conduct. One of its upfront functions is making decisions that affect presidential power. However, its foundational function is in complying with its rules of conduct that ensures the protection of the U.S. Constitution. If that fails, its other functions are meaningless.
And yet, there is a near (?) majority of Americans who think this is just fine, are happy to be lied to, and accustomed to believing instead of knowing. It's heartbreaking to watch this slow-motion train wreck gaining speed from abroad, knowing that it will be a game-changer for the rest of the world as well.
This whole denial of the role of expertise made me think maybe SC justices need not be experts in the law. Maybe we should leave these decisions to the wealthiest people, not the smartest jurists. Wait, have we done that already? Could they be any more obvious in their biases?
There is an hierarchical structure in how the judiciary is to conduct itself. The highest level of oversight resides at the U.S. Supreme Court. They cannot be political. How best to determine if they are political? By auditing it to see if they comply with the rules of professional conduct that regulate their behavior. They have grossly failed in that endeavor.
So I'm beginning to get the feeling that the balance of power isn't really balancing and that the Supreme Court council of wizards type thing is getting out of hand with one too many Saurons.

It’s my understanding that if we get a congressional majority, we can bring at least Clarence Thomas and Samuel Alito up for impeachment.

OK y’all this may be the time when only “we the people” can rebalance the skew of power.
We need a groundswell of art, music, film and writing to build momentum while we search for ways to solve this crisis.
